This website and smartphone application (collectively referred to as the "Platform") are operated by Subhan United Wholesale and Retail Trading Company, a company duly registered and licensed in the State of Kuwait, which owns and operates commercial branches under the trade name "Dukkan – Central Food Market" (hereinafter referred to as "Dukkan," "we," or "us").

Definitions
For the purposes of these Terms, and unless the context otherwise requires:
"The Client" / "You": Any natural person who accesses or uses the Platform.
"Products": Food items, groceries, beverages, consumer goods, and other products offered for sale via the Platform.
"Order": The purchase request submitted by the Customer via the Platform.
"The Platform": The website and application belonging to Dukkan Company.
Scope of Application
These Terms and Conditions ("Terms") govern the following:
Accessing and using the Platform;
Purchasing food items, grocery products, and related goods offered for sale through the platform.
These terms apply to all users, including customers, visitors, and anyone who accesses or uses the platform.
Legal Acceptance and Eligibility
By accessing, browsing, or submitting any request through the Platform, you acknowledge and warrant that you:

You possess the legal capacity to enter into binding contracts in accordance with the laws of the State of Kuwait.
In the event that you do not agree to these terms, you must immediately cease using the platform.
The Platform may not be used, nor may applications be submitted, except by persons aged 18 years or older.
User Responsibilities and Misuse
The User agrees not to misuse the Platform, including—but not limited to—providing incorrect information, mistreating delivery personnel, attempting fraud, or interfering with the operation of the Platform.
Dukkan reserves the right, at its sole discretion and without prior notice, to temporarily or permanently suspend or restrict access to the Platform in the event of a reasonable suspicion of misuse, fraud, or a violation of these Terms.
Nature of Activity and Products
Dukkan operates as a central marketplace for food products, offering groceries, fresh and packaged foods, beverages, household consumables, and other related goods.
Product descriptions, images, and specifications are displayed on the platform for illustrative purposes only; actual products, packaging, weights, or appearance may vary depending on the supplier, availability, or regulatory requirements.
Offers and Contract Formation
7.1 Submission of the Application
Submitting an application via the Platform constitutes an offer by the customer to purchase the specified products.
7.2 Acceptance of the Application:
The sale contract shall not be deemed effective or binding until Dokkan confirms the order via the Platform or through an official communication channel.
Dukkan reserves the right to refuse, cancel, or restrict any order prior to its confirmation, without incurring any liability—including, but not limited to:
Product unavailability
Pricing or Offering Errors
Payment failed.
Reasonable suspicion of fraud or misuse;
Legal or regulatory restrictions.
Prices and Payment Methods
All prices are displayed in Kuwaiti Dinars and may include legally mandated taxes or fees.

Cash on Delivery (if available).
The prices displayed at the time of checkout are considered final for a confirmed order. Dokkan reserves the right to adjust prices prior to order confirmation without prior notice.
Delivery and Pickup
Delivery Area:
Delivery is limited to within the State of Kuwait, subject to coverage area and operational availability.
Delivery Time
The stated delivery times are estimates only, and delays may occur due to operational or logistical reasons, or circumstances beyond our control.
9.3 Order Inspection
The customer must inspect the order upon receipt and report any shortages, errors, or visible damage.
Upon receipt (whenever possible), or
Within 48 hours of receipt, via Customer Service.
Failure to report within this period shall be deemed acceptance of the order, unless the defect was not discoverable upon receipt.
Returns, Refunds, and Consumer Rights
10.1 Legal Rights
Nothing in these Terms limits or excludes mandatory consumer rights established under the laws of the State of Kuwait.
10.2 Foodstuffs and Hygiene Products
Due to health and regulatory considerations, food items, perishable goods, or hygiene products may not be returned after delivery, except in the following cases:
The existence of a defect in the product;
Delivery of an incorrect product;
Or if a return or refund is required by law.
10.3 Damaged Products
If damage, defect, or error is proven,
Dukkan may—at its sole discretion and in accordance with the law—replace the product or refund its value.
Any amounts, if applicable, will be refunded via the original payment method within a reasonable timeframe.
10.4 Promotions & Bundled Items
For products purchased under promotions, refunds or replacements may be conditional upon return of associated gifts or promotional benefits, where legally permissible.
Availability and Exchange
In the event that a specific product is unavailable, Dokkan may:
Replace it with a similar product in terms of value and quality; or
Delete the unavailable product and adjust the order total.
Unless the customer chooses not to allow replacements.
Using the Platform
The user is prohibited from:
Using the Platform for illegal or fraudulent purposes;
Interfering with the security, systems, or operation of the Platform;
Providing false or misleading information;
Misuse of content, intellectual property, or technology.
Dukkan reserves the right to suspend or terminate access in the event of a violation of these Terms.

All trademarks, logos, content, software, and materials displayed on the platform are owned by or licensed to Dukkan, and are protected under applicable intellectual property laws.
No content may be copied, reproduced, or distributed without prior written consent.
Compensation
To the fullest extent permitted by law, the User agrees to indemnify and hold harmless Dokkan, its employees, directors, and affiliates from any claims, losses, damages, or expenses arising out of:
Violation of these terms;
Misuse of the platform;
Violation of applicable laws or regulations.
Privacy and Data Protection

and its published Privacy Policy, which constitutes an integral part of these Terms.
Personal data is collected solely for lawful purposes such as order fulfillment, customer support, regulatory compliance, and fraud prevention.
Limitation of Liability
To the fullest extent permitted by Kuwaiti law.
Dokkan assumes no liability for indirect, incidental, or consequential damages, including loss of profits or business interruption.
In all cases, Dokkan’s liability—if any—shall not exceed the value of the order subject to the claim, without prejudice to any liability that cannot be legally excluded.
Nothing herein excludes liability for fraud, gross negligence, or matters that cannot be legally excluded.
Force Majeure
Dokkan shall not be held liable for any delay or failure in performance resulting from circumstances beyond its reasonable control, including natural disasters, acts of war, government directives, system failures, or supply chain disruptions.
In such cases, Dukkan may cancel the affected orders and refund any amounts paid—if applicable—without incurring any additional liability.
Amendments
Dokkan reserves the right to modify these Terms at any time. The updated version will be published on the Platform and shall become effective from the date of its publication. Continued use of the Platform constitutes acceptance of these modifications.
Applicable Law and Judicial Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait.
The courts of the State of Kuwait shall have exclusive jurisdiction to adjudicate any dispute arising therefrom, without prejudice to any mandatory consumer protection mechanisms.
